Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services and amending Directive 2000/31/EC (OJ L 277, 27 October 2022, p. 1; hereinafter: the Digital Services Act or DSA) has applied since 17 February 2024. The DSA updates the rules governing online services and addresses systemic societal risks arising from the dissemination of illegal content online and the insufficient protection of fundamental rights.
For providers of hosting services, the Digital Services Act requires the establishment of mechanisms enabling any individual or entity to notify them of the presence of specific information in their service that the individual or entity considers to constitute illegal content.
The Digital Services Act (DSA) specifies the elements that a notice of illegal content must contain, namely:
(a) an explanation of the reasons why the individual or entity submitting the notice considers the information in question to be illegal content;
(b) a clear indication of the exact electronic location of that information, such as the exact URL or URLs, and, where necessary, additional information enabling the identification of the illegal content, depending on the type of content and the specific hosting service;
(c) the name and email address of the individual or entity submitting the notice, except in the case of information that is deemed to involve one of the criminal offences referred to in Articles 3 to 7 of Directive 2011/93/EU;
(d) a statement confirming that the individual or entity submitting the notice has a good-faith belief that the information and allegations contained in the notice are accurate and complete.
